The use of this site is conditional on your acceptance of the following User Agreement, Terms and Conditions, and Privacy Policy: Intended Use: Auction Zealot is used to list items to the eBay US website and has no intended use in the EU or anywhere else that the GDPR applies. See point 3 in the User Agreement below. User Agreement 1. Persons under 18 are not eligible to use nor permitted to submit information to this site. 2. You must have a United States seller's account with ebay to use this site. 3. You must not be under the jurisdiction of the European Union wherever the General Data Protection Regulation (GDPR) applies. 4. You agree to have a working email address on file with ebay as long as you use this site. 5. You agree to protect the password that gains access to this site. 6. You agree not to use the Auction Zealot services to violate the law. 7. You agree not to post information or graphics on this site that is fraudulent, libelous, obscene (as determined by Auction Zealot staff), defamatory, abusive, threatening, pornographic, or damaging in any way, or that infringes on copyrights or trademarks or can be construed as an invasion of privacy. This includes anything that qualifies to be listed within the "Mature Audiences" or "Metaphysical" categories. You agree not to solicit on the member forum on this site except as related to ebay listings. 9. You agree not to use the Auction Zealot services in a way that creates a disproportionately large load (as determined by the Auction Zealot staff) on our servers. 10. You agree to adhere to the ebay user agreements and conditions when placing ebay listings using the Auction Zealot services. 11. You agree not to hack into the Auction Zealot program or otherwise interfere with the operation of the Auction Zealot services. 12. You agree not to reproduce, distribute, adapt, modify, or reverse engineer any parts of the Auction Zealot program. 13. You agree to report any bugs or errors that you discover in the program immediately to the message board or bug-reporting feature. Terms and Conditions 1. When signing up for the first time, user has permanent access to all free features. Upon payment of the price for citizenship, user's account is upgraded to "citizen", which grants full access to all Auction Zealot features. When user's citizen access period has ended, the user is downgraded back to member status and can continue to use the service for free. But their features are once again limited to free features only. 2. If user submits a cancellation (see Options menu), all user’s information kept on the Auction Zealot servers will be deleted automatically in 7 days and access to the site via that username denied at that time. User will be able to reverse cancellation at any time before the 7-day deadline. 3. We (the owner or agents of Auction Zealot) may change the Auction Zealot’s fees or fee structure by giving at least 30 days notice. The notice will be posted in the news on the Home Page. 4. Your email will never be sold to third parties. You may get an occasional newsletter from Auction Zealot and promotional offers from future web products that share a common affiliation or ownership with Auction Zealot. These types of email are very rare (once or twice a year) and you can unsubscribe at any time in the Options Menu. 5. Auction Zealot is provided as an “as is” service and should be used at the user's own risk. We offer no actual or implied warranties with regard to fitness for a particular purpose, performance, availability, security, or accessibility. We shall not be held liable for any reason (including negligence) for any actual or consequential losses or damages (including loss of data, loss of profits, interruption of business) arising out of use of or inability to use the Auction Zealot site or services. All features for both citizens and non-citizens are provided "as is" and there is no guarentee that they will work or liability for Auction Zealot if they do not. We qualify this disclaimer by reassuring the user that we will do the best we can to make the system work well, but there is no guarentee. 6. We assume no liability for any actual or consequential losses or damages arising out of any user’s violation of the User Agreement. We will (at our discretion) give an offending user a warning and/or immediately terminate that user’s account upon notice that the user has violated any part of the User Agreement. When a user’s account is terminated, the user will immediately be denied access to the Auction Zealot site. 7. In no event (including any provision of the Terms and Conditions, User Agreement, or Privacy Policy being found unenforceable) will our liability exceed the amount of a single month’s fees that the user paid immediately prior to the time the action (giving rise to the liability) took place. 8. Users will have no proprietary rights to design combinations that they created using the Auction Zealot design center. Any such design combinations may be used by other Auction Zealot users or as templates by Auction Zealot. If a design combination is used as an Auction Zealot template a name will be assigned to it and the user's Auction Zealot username may be added as a courtesy (i.e. Checkered Curtain by wildcowboy352). 9. User-imported designs are imported at the user's own risk. We assume no liability for the security or accessibility of these designs. While user-imported designs will not be seen by other users in their respective Auction Zealot environments, anything displayed on the Internet (ebay and elsewhere) is accessible to all and might possibly be purloined using various techniques by anyone viewing the Internet. 10. We reserve the right to terminate services to any user (or every user) at our discretion upon notice given individually by email or collectively by a statement on the Home Page or message board. 11. We reserve the right to disclose user information to law enforcement agencies as a result of subpoena. 12. Auction Zealot LLC. denies responsibility and assumes no liability for the actions of any eBay account hijacker than signs up on Auction Zealot using someone else's eBay account. It is the responsibility of every eBay user to safeguard their own eBay accounts. 13. Auction Zealot LLC. denies responsibility and assumes no liability for the actions of any hacker that violates our terms and conditions by interfering or abusing other Auction Zealot users in any way using methods known or unknown to us. We qualify this disclaimer by reassuring the user that every means known to us continue to be taken to harden the system against hackers that would interfere in some way. 14. For best compatibility with Auction Zealot, we support the following web browsers: Internet Explorer 6, Internet Explorer 7, Firefox 2 for Windows XP, Firefox 2 for Mac OS X, or Firefox 2 for Linux. Perfect functionality cannot be guarenteed when using other browsers. Privacy Policy In order to keep records, bill, and interface with ebay we will need to collect certain information. During the registration process you will be asked to supply an Auction Zealot username and a password. After obtaining a token, ebay will provide us with your email address and ebay user ID. Voluntarily you may provide your name, address, and/or telephone number. You will also provide data as needed to create and launch your listings. The information obtained by us will be used to interface with ebay, to send you emails pertaining to Auction Zealot and other promotional offers, for compilation of statistical data used solely within the Auction Zealot environment, and optionally to send invoices to your buyers (when and if this feature becomes available). We will not sell, rent, or give away your personal information except as required in part 11 of Terms and Conditions. Please be aware that we shall not be responsible for nor can we control the use of any information you voluntarily disclose when using the member forum. Auction Zealot is compliant with ebay security requirements for auction managers. Your information will be stored on a server where the general public does not have access to it. We will take reasonable and prudent steps to protect your information but will make no warranties (actual or implied) with regard to the sufficiency of the security measures. You may change or delete your personal information at any time by going to the Options menu. If any provision of the User agreement, Terms and Conditions, or Privacy Policy is prohibited by federal or individual state law or unenforceable for any reason the remaining provisions will be unaffected and remain in force. The User Agreement, Terms and Conditions, or Privacy Policy or any part thereof may be revised, amended, or replaced at our discretion. A notice of any changes will be posted on the Home page and will take effect upon posting.
